Court proceedings

We are professional litigators, and represent our clients before all courts in the Czech Republic and Slovakia. We are not limited to individual regions or specific courts. Even before the Czech Constitutional Court in Brno, we regularly and successfully represent our clients.

We also frequently represent our clients before courts in other European countries. These are usually cases in which Czech or Slovak law on the one hand and foreign law on the other become relevant. These cases are particularly challenging for all parties involved, including the judges. Here it is important to rely on experienced legal advisors such as our litigation team. Arbitration proceedings

Especially in cross-border commercial disputes - whether in real estate, financing, M&A, etc. - not only traditional court proceedings are important. Arbitration proceedings are particularly common and important in these areas.

We frequently represent our clients not only before state courts, but also in arbitration proceedings in Germany, the Czech Republic, Slovakia and other European countries under the arbitration rules of

  • the ICC

  • the Arbitration/Arbitral Court attached to the Chamber of Commerce of the Czech Republic, and Chamber of Agriculture of the Czech Republic

  • DIS (German Institution of Arbitration).

We also protect our clients against the enforcement of unlawful arbitral awards and have special expertise in the suspension of enforcement and challenge of arbitral awards.

Enforcement of and protection from international judgments and arbitral awards

We assist you with the enforcement of national and international judgments and arbitral awards in the Czech Republic and Slovakia. We regularly enforce judgments and arbitral awards from other countries against debtors in the Czech Republic and Slovakia. We also protect our clients against the enforcement of unlawful foreign judgments and arbitral awards.

Our local experience is one of our advantage in these cases, as enforcement procedures work differently here than in other countries. The country of origin of the judgment e.g. another EU country, the US or a country with which an international legal assistance agreement exists makes a major difference in the enforcement. The first prerequisite for successful enforcement is recognition of the foreign judgment arbitral awards or other title by the competent court in the Czech Republic or Slovakia. This procedure has many pitfalls and requires sufficient experience. The next step is to choose the most appropriate enforcement method for you. An experienced, state-approved but non-judicial "Executor" is usually recommended.

If you choose to have a foreign judgment enforced in the Czech Republic or Slovakia, we will organize everything you need, such as official translations, extracts from registers and the necessary powers of attorney.

We also protect our clients against the enforcement of unlawful arbitral awards and foreign judgements and have special expertise in the suspension of enforcement proceedings and challenge of arbitral awards.
